Contract to Purchase

 

This contract is for the purchase of one (1) (sex / color / pattern) Tabby Bengal kitten born (DOB) to (name of Sire with SBT#) and (name of Dam with SBT#). Terms of sale are as follows:

1. Paid in full. YES / NO

2a. Price of kitten is $_________ to be paid in full at time kitten is received by Buyer. There is a non-refundable deposit of $_________ should the Buyer not fail to complete the terms and conditions of sale. Seller may elect to stop sale at any time prior to the delivery of kitten to Buyer. In the case of the Seller stopping a sale, all money paid by Buyer will be returned to Buyer within 10 business days of notification by Seller that the kitten will not be delivered to Buyer and that the sale has been stopped by Seller.

2b. In the case where a verbal agreement has been tentatively reached but there has not been a signed contract or deposit received to hold a specific feline being offered for sale, the kitten/cat is considered not to be under contract for sale and the Seller may terminate the agreement at any time prior to the delivery of the kitten to the Buyer.

3. Kitten is guaranteed by Seller to be free of the following health conditions at time of delivery to Buyer: FeL/FIV, FIP and congenital defect affecting the life of the kitten.

Kittens found to have FeL/FIV or FIP may be returned for a replacement kitten of equal value (determined by the Seller) when one becomes available. The Seller does not guarantee against minor health conditions that arise after the kitten has left this cattery such as respiratory symptoms or gastrointestinal disorders. The Seller will further guarantee against death due to a congenital defect up to the first anniversary, (date), of the birth of the kitten. Should the kitten die due to a congenital defect during the warranty period, the Seller will offer a replacement kitten of like quality to be determined by the Seller when one becomes available. A full necropsy report, at the buyers expense, must be submitted to the seller before a replacement will be offered. In addition, the Seller guarantees against a positive (not equivocal) test for HCM up to the second anniversary of the birth of the kitten (date) only for kittens purchased with breeding rights. The Buyer assumes all costs of HCM screening and subsequent treatment due to a diagnosis of HCM. HCM test/screen must be completed by a Cardiology Board Certified Veterinarian. The Buyer will accept responsibility for all costs incurred in the shipping or picking up of the replacement kitten. In the case of a replacement kitten due to death or a positive HCM screen, the Seller may substitute Brown Spotted/Marble for Silver Spotted/Marble (as applicable) as Silver is not bred for in this cattery and is not always available.

4. Kitten must be evaluated within seven business days by a licensed Veterinarian upon receipt by Buyer. It is strongly suggested that the buyer have the kitten tested, at the buyers expense, for any and all conditions that may be covered by the sellers guarantee. The sellers health guarantee extends only to the seven day period to be pronounced healthy by the buyers Veterinarian of choice. The seller does not guarantee against minor illnesses that develop during shipment or after delivery of the kitten to the buyer. Failure to have the kitten evaluated within seven days renders the health guarantee void. If the kitten is found to have a condition that is covered by the health guarantee, the seller retains the right to have the kitten evaluated by our own Veterinarian to confirm said condition.

5. Kitten is to remain on diet of Royal Canin Kitten Chow and Taste of the Wild Cat Chow for a period of three weeks.

6. Seller does not guarantee against future litter habits or personality of kitten. Kitten is noted to be well socialized with good litter habits at time of transfer to buyer.

7. Kitten is purchased as a pet without breeding rights. Kitten must be neutered no later than (Date) with confirmation of neutering
provided in writing (Vet receipt) to Seller. Failure to neuter kitten by said date entitles Seller to an additional $2,000 (two thousand dollars) payable immediately by certified funds to the Seller. Buyer will then receive all breeding rights to the kitten.

8. Buyer acknowledges that there may be a cat or cats in this kitten’s pedigree that are listed as having been exported/imported without a CITES permit. This may or may not impede International movement of this kitten and its offspring.

9. Any and all legal fees associated with the enforcement of this contract will be at the buyers expense.

10. Seller will provide TICA Registration paperwork to buyer by mail within 30 business days of receipt of the kitten.

11. Buyers are restricted from selling this kitten or the immediate offspring of this kitten in the State of Tennessee. There will be a $1500.00 (US Dollar) penalty immediately payable to this cattery for each and every kitten sold that violates this policy. This will be payable by the Buyer of this kitten who has signed this contract.

13. This kitten may be re-sold as a breeder only one time. This kitten MUST then be neutered by the receiving breeder at the conclusion of his use as a breeder and placed as a neutered pet. No immediate offspring of this kitten may be sold in the State of Tennessee. There will be a $1500.00 (US Dollar) penalty immediately payable to this cattery for each and every kitten sold that violates this policy. This will be payable by the original Buyer of this kitten who has signed this contract.

12. All sales final. Refund or exchange only for health related conditions noted earlier.
